Important — please read before using the platform
By accessing or using the SmartTrading platform (the "Service"), you confirm that you have read, understood, and agree to be bound by these Terms of Service and Risk Disclosure ("Terms"). If you do not agree to all of these Terms, you must immediately discontinue your use of the Service. We may modify these Terms at any time; continued use after the effective date of any update constitutes acceptance of the revised Terms.
SmartTrading provides an AI-powered portfolio risk management and analytics platform that includes portfolio tracking, quantitative risk scoring, AI-generated research insights, automated stop-loss monitoring, real-time price alerts, and related tools. The Service is intended to support informed decision-making; it does not execute trades on your behalf or interface directly with any brokerage unless you configure a supported integration.
SmartTrading ("Platform") provides educational and informational tools, including analytics, charts, alerts, and AI-generated insights. The Platform does not provide investment, legal, tax, or business advice and is not a registered investment adviser, broker, or dealer in any jurisdiction. All content is provided for general informational purposes only. You are solely responsible for evaluating and making your own trading and investment decisions. You should consult qualified professionals — including licensed financial advisers, attorneys, and accountants — before making any financial decisions.
Trading securities and other financial instruments involves substantial risk of loss. You may lose some or all of your invested capital. Past performance of any security, portfolio, or strategy is not indicative of future results. The risk scoring and analytics provided by the Platform represent probabilistic assessments, not guarantees. You are responsible for determining whether any investment, strategy, or transaction is appropriate given your personal financial situation, objectives, and risk tolerance.
Automated stop-loss monitoring features are provided as a risk-management aid, not a guaranteed execution mechanism. By using these features, you acknowledge and agree that: (a) execution delays may occur due to market volatility, exchange conditions, system latency, or network interruptions; (b) slippage may result in execution at a price materially worse than the configured stop-loss level; (c) no guarantee of execution is provided and orders may be rejected, partially filled, or executed at unfavorable prices; and (d) system failures, including third-party outages, may impact the timing or reliability of alerts. You remain fully responsible for all trading outcomes.
The Platform includes AI-generated reasoning, summaries, and qualitative risk adjustments powered by large language models. AI outputs: (a) may contain inaccuracies, factual errors, or misinterpretations of data; (b) may be based on incomplete, delayed, or stale third-party data feeds; and (c) reflect probabilistic assessments, not guarantees of market outcomes. AI insights are intended to supplement, not replace, your own due diligence. Do not rely solely on AI-generated content when making trading or investment decisions.
The Platform relies on external data providers including Finnhub, TwelveData, Polygon, and Yahoo Finance. Market data may be delayed, incomplete, or temporarily unavailable due to vendor outages, licensing constraints, or system maintenance. The Platform does not warrant the accuracy, completeness, or timeliness of third-party data. Real-time data may require a supported data provider subscription.
You must be 18 years of age or older to create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorised access or suspected breach. We will never ask for your password by email or phone. We reserve the right to suspend or terminate accounts that violate these Terms or where we suspect fraudulent activity.
You agree not to: (a) use the Service for any unlawful purpose or in violation of applicable regulations; (b) attempt to gain unauthorised access to any portion of the Service or its infrastructure; (c) use automated scripts, bots, or scrapers to extract data from the Service without our written consent; (d) redistribute, resell, or white-label the Service or its outputs without a written licensing agreement; (e) upload or transmit malicious code, viruses, or any software intended to damage or interfere with the Service; or (f) use the Service to engage in market manipulation or any activity that violates securities laws.
All content, software, algorithms, models, interfaces, and data compilations provided by the Service are the intellectual property of SmartTrading or its licensors and are protected by copyright, trade secret, and other applicable laws. You are granted a limited, non-exclusive, non-transferable licence to access and use the Service for your personal, non-commercial purposes. You may not reproduce, modify, distribute, or create derivative works based on any Service content without our prior written consent. Your portfolio data remains your property; by submitting it to the Service, you grant us a limited licence to process it solely to deliver the Service to you.
The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or free from viruses. We make no warranty regarding the accuracy, reliability, completeness, or timeliness of any content, data, or analysis provided through the Service.
To the maximum extent permitted by applicable law, SmartTrading and its affiliates, officers, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages arising out of or related to your use of or inability to use the Service, including but not limited to trading losses, lost profits, missed opportunities, data loss, or system downtime, even if we have been advised of the possibility of such damages. Our total aggregate liability for any claims arising under or related to these Terms shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim or (b) USD $100.
You agree to indemnify, defend, and hold harmless SmartTrading and its developers, officers, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your access to or use of the Service; (b) your violation of these Terms; (c) any trading or investment decisions you make in connection with information provided by the Platform; or (d) your violation of any applicable laws or regulations. This obligation survives termination of your use of the Service.
Either party may terminate your access to the Service at any time. You may close your account by contacting support. We may suspend or terminate your access immediately, without notice, if we determine in our sole discretion that you have violated these Terms, engaged in fraudulent activity, or pose a security risk to the platform or other users. Upon termination, your right to use the Service ceases immediately. We will retain your data for 30 days following termination to allow for any export requests, after which it will be deleted in accordance with our Privacy Policy.
The operator of SmartTrading does not hold a licence as an investment adviser, investment marketer, or portfolio manager under the Israeli Investment Advising, Investment Marketing and Portfolio Management Law, 5755-1995 (the "Investment Advising Law"). The Platform does not constitute investment advising, investment marketing, or portfolio management services as defined under the Investment Advising Law or any equivalent regulation in any other jurisdiction. All content, analysis, and tools provided by the Platform are for educational and informational purposes only and must not be construed as a regulated financial service.
By accessing or using the Platform, you represent and warrant that: (a) you are at least 18 years of age; (b) you have the full legal capacity and authority to enter into a binding agreement and to be bound by these Terms; (c) you are not prohibited by applicable law from accessing or using the Platform; and (d) your use of the Platform does not violate any applicable laws or regulations in your jurisdiction. If you do not meet these eligibility requirements, you must immediately discontinue all access to and use of the Platform.
These Terms shall be governed by and construed in accordance with the laws of the State of Israel, without regard to its conflict of law principles. You hereby irrevocably submit to the exclusive jurisdiction of the courts of Tel Aviv-Yafo, Israel, for the resolution of any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Platform, except where mandatory consumer protection laws in your jurisdiction require otherwise. You waive any objection to the laying of venue in Tel Aviv-Yafo, Israel, and waive any claim that such proceedings have been brought in an inconvenient forum.
We may update these Terms at any time by posting the revised version to the Platform with an updated effective date. For material changes, we will provide notice via email or a prominent in-app notification at least 14 days before the changes take effect. Continued use of the Platform after the effective date constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must discontinue use and close your account.
